Before 2002 there was a 'complaint delict' for children between the age of 12 and 15, which means that these children were allowed to engage in sexual contacts with adults unless the child or its parents filed a complaint about it. Now the 'complaint delict' is gone but even now (according to the law at least) not all sexual contacts with adults are strictly forbidden, only sexual contacts with children below the age of 12 are in all cases unlawful.
There are basically three conditions under which sexual contact between adults and children between the age of 12 and 15 will not be prosecuted under the current law:
1.) The child and adult are married with each other. This is very rare though.
2.) The prosecutor/judge decide not to bring the adult before court after hearing the child's testimony. The law states that the child has to be heard and listened to before trial, after which the case can be dismissed. This does not seem to happen very often though, even if the child claims the sexual contact was completely consensual and doesn't want the adult to be prosecuted.
3.) The age difference between the child and adult is not greater than ~5 years. This is not a strict limit though, sometimes greater age differences are allowed. It depends on the judge's moral views and that of society. 5 years difference is generally regarded as a safe limit now, but this may or may not change in the future though.
